
SZ COLLECTION TERMS AND CONDITIONS
All sales are subject to the following terms and conditions:
1. PRICES: All prices are subject to change without notice. Orders will be billed at the prices prevailing at the time the order is place. Customers must notify SZ Global, LLC, and DBA SZ Collection (hereinafter referred as “SZ” in writing within 5 days after receipt of any invoice of any price disputes.
2. ORDERS: All orders are subject to acceptance by SZ. SZ reserves the right to prohibit certain SZ product from being advertised and or sold via internet. SZ may immediately terminate the account of any Customer selling SZ products without written authorization, and may bring legal action as well. All sales of closeouts, irregular, seconds, and/or samples are final. All new customers must complete order application form, providing all the necessary information, including but not limited to: Copy of Tax ID, credit card information, and bank reference.
3. TERMS OF PAYMENT: F.O.B shipping point. Payment for ordered goods is due and payable pursuant to these terms and conditions or expressly written in order form at the time of the sale. All orders shall be secured with the proper credit card information. All orders will be secured with a non-refundable 30% deposit.
4. RESTRICTIONS ON SALES: Customer is prohibited from selling SZ products other than through a SZ approved channel of distribution. Customer must purchase all SZ products from SZ.
5. CANCELLATION: All requests to cancel orders must be submitted in writing to SZ at least 45 days before start shipping date and must be approved by SZ. SZ reserves the right to charge a percentage of the order for product ordered and cancelled.
6. DELIVERY: Customer assumes the risk of damage to or loss of the product in delivery by SZ to customer. Customer must note product damage or loss to carrier on carrier's delivery receipt and notify carrier immediately of discovery of any such damage or loss. Customer must report all concealed shortages or overages to SZ credit department as soon as order is delivered.
7. RETURN POLICY: All returns are subject to re-stocking charge and must be approved by SZ. Customer is responsible for all shipping and handling charges incurred in returning product. Customer must notify SZ of its intent to return product. Return request must be accompanied by an order number or invoice. All products must be returned in the same condition in which they were received. Including the returning of all packaging such as boxes and dust bags. All returns must be shipped to our warehouse location: SZ Collection – 116 King Court – Industrial Park – New Holland, PA 17557. Returns are only accepted if the product shipped is defective or if the wrong item was shipped. Re-stocking fee may be waived if the product is defective or wrongly shipped.
8. LIMITATION OF LIABILITY: In no event shall SZ be liable to the customer for any loss of profit, interruption of business or any special, indirect, consequential or incidental damages arising in contract, in tort, under warranty or otherwise, even if SZhas been appraised of the possiblity of such damages.
9. FORCE MAJEURE: SZ shall not be liable for any failure or delay in delivery or in its performance under these terms and conditions due to any cause beyond SZ's reasonable control, including without limitations, any act of war or civil insurrection, national emergencies, act of God, fire, explosion, storm, earthquake, flood, embargo, riot, sabotage, industry-wide strikes, lockouts, labor difficulties, supplier failures, unavailability of materials, or governmental acts. Where a product scheduled for delivery becomes unavailable as a result of a force majeure event, SZ may offer a substitute product for which the new purchase order will be required from customer.
10. GENERAL: These terms and conditions shall be governed by the laws of Pennsylvania, United States of America.
